EXPLANATORY MEMORANDUM |

AN ACT TO PROVIDE FOR THE AMENDMENT
OF SECTION 29 (2) AND (3) OF THE NATIONAL DRUG LAW ENFORCEMENT AGENCY ACT,
CAP. 253 LAWS OF THE FEDERATION AND FOR CONNECTED PURPOSES |
This Bill seeks to improve the
financial capacity of the NDLEA by stopping all payments of the funds
collected by the Agency into the Consolidated Revenue Funds of the Federation
so that the Agency can retain those funds in order to discharge its
obligations without any financial difficulties. |

AN ACT TO ENABLE THE FEDERAL
GOVERNMENT OF NIGERIA IMPOUND AND APPLY ALL LOOTED PUBLIC FUNDS DEPOSITED IN
FOREIGN BANKS TOWARDS REPAYMENT OF FOREIGN DEBTS; AND FOR CONNECTED PURPOSES |
This Bill seeks to allow the Federal
Government of Nigeria apply all looted public funds recovered from the
foreign banks directly towards repayment of foreign debts.
This Bill also seeks to encourage
foreign governments where Nigeria’s stolen monies are kept to persuade
their banks to impound such monies on behalf of Nigeria bearing in mind that
the monies should be used to pay off foreign debts and should not be
transferred to Nigeria. |

AN ACT TO AMEND THE CRIMINAL CODE
ACT CAP. 77 BY ADDING A NEW CHAPTER TO THE SCHEDULE |
The Bill seeks to amend the Criminal
Code Act Cap. 77 Laws of the Federation 1990 by adding a new chapter –
"Chapter 56 OFFENCES RELATING TO PUBLIC INSTALLATIONS" to the
Schedule to the Act.
The Bill further spells out offences
against public Installations and prescribe punishment for them accordingly. |

AN ACT TO AMEND THE PENAL CODE
(NORTHERN STATES) FEDERAL PROVISIONS ACT CAP. 345 LAWS OF THE FEDERATION OF
NIGERIA 1990 BY ADDING NEW SECTION THEREOF |
The Bill seeks to amend the Penal
Code (Northern States) federal Provisions Act Cap. 345 Laws of the Federation
1990 so as to bring in offences relating to Posts and Telecommunication and
to prescribe for them accordingly. |

AN ACT TO AMEND THE REMUNERATION OF
FORMER PRESIDENTS AND HEADS OF STATE (AND OTHER ANCILLARY MATTERS) DECREE NO.
32 OF 1999 SO AS TO INCLUDE FORMER SENATE PRESIDENTS, SPEAKERS – HOUSE OF
REPRESENTATIVES, CHIEF JUSTICE OF NIGERIA, DEPUTY SENATE PRESIDENTS, DEPUTY
SPEAKERS – HOUSE REPRESENTATIVES AND THE PRESIDENTS OF COURT OF APPEAL FOR
THE REMUNERATION AND OFFICE PERQUISITES THEREOF; AND RELATED MATTERS |
A Bill seeks to amend Remuneration
of Former Presidents and Heads of State (And other Ancillary Matters) Bill
1999.
The purpose of the Bill is to
include former Senate Presidents, Speakers – House of Representatives,
Chief Justice of Nigeria, Deputy Senate Presidents, Deputy Speakers – House
of Representatives and Presidents Court of Appeal for the remuneration and
office perquisites thereof; and for related matters. |

MAKE PUBLIC RECORDS AND INFORMATION MORE FREELY AVAILABLE, PROVIDE FOR PUBLIC
RECORDS AND INFORMATION, PROTECT PUBLIC RECORDS AND INFORMATION TO THE EXTENT
CONSISTENT WITH THE PUBLIC INTEREST AND THE PROTECTION OF PERSONAL PRIVACY,
PROTECT SERVING PUBLIC OFFICERS FROM ADVERSE CONSEQUENCES FOR DISCLOSING
CERTAIN KINDS OF OFFICIAL INFORMATION WITHOUT AUTHORIZATION AND ESTABLISH
PROCEDURES FOR THE ACHIEVEMENT OF THOSE PURPOSES; AND RELATED PURPOSES
THEREOF |
This Bill
seeks to provide a right to public information or
records kept by government, public
institutions and/or private bodies carrying out public functions for citizens
and non-citizens of the country.
This will increase the availability
of public records and information to citizens of the country in order to
participate more effectively in the making and administration of laws and
policies and to promote accountability of public officers.
The Bill also seeks to provide the
disclosure of public records or information by public officers without
authorization thereof provided it is for public interest and such officers
are protected from adverse consequences flowing from such disclosure. |

AN ACT TO PROVIDE SPECIAL FACILITIES
FOR THE USE OF HANDICAPPED PERSONS IN PUBLIC BUILDINGS |
This Bill seeks to make provision
for special facilities in Public Buildings for accessibility and usability
for physically handicapped persons.
It further seeks to establish a
Nigerian National Standard for Public Building and facilities for
accessibility and usability for physically handicapped persons. |

AN ACT TO AMEND THE PENAL CODE

NIGERIA 1990 BY PROVIDING FOR PUNISHMENT OF TREASON AND TREASONABLE FELONY AT
ANY TIME A CIVILIAN GOVERNMENT IS RE-ESTABLISHED |
This Bill seeks to amend the Penal
Code (Northern States), Federal Provisions Act Cap. 345 Laws of the
federation of Nigeria, 1990 by providing for punishment of treason and
treasonable felony at anytime a civilian government is re-established.
The Bill further provides that the
punishment is irrespective of whether or not the Principal Act or the
Constitution has been amended |

AN ACT TO INTEGRATE NON-INDIGENES
INTO STATE OTHER THAN THEIR STATES OF ORIGIN |
This Bill seeks to integrate
non-indigenes of a State into that State for having lived there continuously
for 5 years.
The Bill further seeks to confer on
them such rights and benefits as if they are indigenes of such States. |
| AN ACT TO
PROHIBIT ESTABLISHMENT (FORMATION), MEMBERSHIP OR ACTIVITIES OF CULT AND
SECRET SOCIETY; AND RELATED MATTERS THEREOF |
This Bill
seeks to prohibit the establishment (formation) of any cult or secret society
and any activity thereof. It further prohibits the existence of any cult or
secret society established (formed) before the commencement of this Bill.
Anything related to cult or secret society if prohibited. A penalty had been
provided for any contravention of any of the provisions of this Bill. |
